Clausola di non riesportazione in Russia, ai sensi dell'Articolo 12-octies del Regolamento (UE) 833/2014, come modificato:
1. **Divieto di Riesportazione**: Il Fornitore/Esportatore vieta espressamente al Compratore/Controparte la riesportazione dei beni oggetto del presente contratto in Russia o per un uso in Russia, anche indirettamente.
2. **Beni Interessati**: Tale divieto si applica ai beni elencati negli Allegati XI, XX, XXXV e XL del Regolamento (UE) 833/2014 e all'Allegato I del Regolamento (UE) 258/2012 (es. beni aeronautici, carburanti, armi, tecnologia avanzata, semiconduttori).
3. **Rimedi**: Qualsiasi violazione di tale divieto da parte del Compratore/Controparte costituirà un inadempimento contrattuale grave. Il Fornitore/Esportatore avrà diritto a risolvere il contratto, richiedere il risarcimento dei danni e, se del caso, avvalersi di altri rimedi previsti dalla legge applicabile.
4. **Obbligo di Segnalazione**: Il Compratore/Controparte si impegna a informare immediatamente il Fornitore/Esportatore di qualsiasi sospetto di violazione del presente divieto da parte di terzi. Il Fornitore/Esportatore, a sua volta, si impegna a segnalare ogni violazione accertata alle autorità competenti dello Stato membro di residenza/sede.
5. **Dichiarazioni**: Il Compratore/Controparte dichiara di essere a conoscenza del presente obbligo e si impegna a non riesportare i beni in Russia, neanche per un uso in Russia."
Non-Re-Export Clause to Russia pursuant to Article 12g of Council Regulation (EU) No 833/2014, as amended
Prohibition of Re-Export: The Supplier/Exporter expressly prohibits the Buyer/Counterparty from re-exporting the goods covered by this contract to Russia or for use in Russia, whether directly or indirectly.
Goods Concerned: This prohibition applies to the goods listed in Annexes XI, XX, XXXV and XL of Regulation (EU) No 833/2014 and in Annex I to Regulation (EU) No 258/2012 (e.g. aeronautical goods, fuels, weapons, advanced technology, semiconductors).
Remedies: Any breach of this prohibition by the Buyer/Counterparty shall constitute a material breach of contract. The Supplier/Exporter shall be entitled to terminate the contract, claim damages and, where applicable, avail itself of any other remedies provided for under the applicable law.
Reporting Obligation: The Buyer/Counterparty undertakes to immediately inform the Supplier/Exporter of any suspicion of a breach of this prohibition by third parties. The Supplier/Exporter, in turn, undertakes to report any established breach to the competent authorities of the Member State of its residence/registered office.
Representations: The Buyer/Counterparty declares that it is aware of this obligation and undertakes not to re-export the goods to Russia, including for use in Russia.
